The US Bureau of Industry and Security (BIS) is now systematically reviewing legally structured offshore compute-rental agreements, not just illegal chip smuggling, to determine if they violate the intent of US export-control law. According to people familiar with the matter who spoke to Bloomberg on condition of anonymity, the division that typically investigates export-control violations is examining legal channels through which Chinese AI companies rent computing power from data centers in third countries, accessing Nvidia chips without those chips crossing a border. For data-center operators in Malaysia, Singapore, Japan, and the United Arab Emirates that serve Chinese AI clients, this review represents a qualitatively different risk than prior enforcement history, as scrutiny now falls on transactions their lawyers told them were legal. Under current Export Administration Regulations, providing a foreign customer remote access to a GPU is not legally an "export" of that GPU, as stated in BIS advisory opinions issued in 2009, 2011, and 2014. Cloud providers are not exporters; cloud users are, only when they download or transfer controlled technology. A Chinese AI company sending training data to a Malaysian server farm, running its model on Nvidia H100s, and receiving model weights back never triggers the standard export-control mechanism because the chips never move. The Bloomberg report signals BIS is asking whether that technical compliance is a legal defense.
