Google Beats Suit Over Data Tracking by Gemini AI Assistant

Google LLC defeated a proposed class action alleging it used its Gemini AI assistant to illegally track private communications of Gmail, Chat, and Meet users. Judge Noël Wise of the US District Court for the Northern District of California granted Google’s motion to dismiss on Tuesday, ruling that plaintiffs failed to allege a concrete harm sufficient to establish standing. The plaintiffs, Thomas Thele and Melo Porter, alleged that Google silently changed settings in October 2025, turning on its AI tool by default to collect private data without consent. The lawsuit brought claims including intrusion upon seclusion, invasion of privacy under the California Constitution, and violations of the Stored Communications Act, the California Invasion of Privacy Act, and the California Computer Data Access and Fraud Act. Judge Wise said the plaintiffs did not allege when they signed up for services, why they chose Oct. 10, 2025, as the start date, whether Gemini features were enabled when they created accounts, or whether they had disabled them. They also failed to identify personal data accessed or used. “Plaintiffs have so far only alleged that Gemini could be used to track their data,” Wise said. “This is insufficient to allege an injury in fact.” The dismissal was granted with leave to file an amended complaint.
