At least six states have taken action against AI chatbots that deliver mental health care, splitting four different ways. Illinois and Nevada banned the practice outright. Utah requires chatbots to disclose they are AI and promise to keep user data private. New York requires chatbots to catch users heading toward self-harm and steer them to crisis help. Texas and Pennsylvania pursued companies under existing consumer-protection and medical-licensing rules. Illinois' Wellness and Oversight for Psychological Resources Act, signed by Governor JB Pritzker on Aug. 1, 2025, forbids AI from making therapeutic decisions, holding therapy conversations, drafting treatment plans without a licensed professional's sign-off, or reading a client's emotions. Licensed therapists can use AI for clerical work, but recording or transcribing a session requires written client permission. Violations cost up to $10,000 per violation, enforced by the state's Department of Financial and Professional Regulation. Nevada's Assembly Bill 406, signed by Governor Joe Lombardo on June 5, 2025, extends its ban into public schools, blocking AI providers from offering chatbots built to deliver mental or behavioral health care. In schools, AI is kept out of work by counselors, psychologists, and social workers involving student mental health, though staff can use AI for scheduling or notes.
