Anthropic and its CEO Dario Amodei filed motions on Monday (August 3) in the US District Court for the Northern District of California seeking to dismiss parts of a second copyright infringement lawsuit brought by Concord Music Group, Universal Music Publishing Group and ABKCO over more than 20,000 songs. Anthropic asked the court to dismiss the publishers’ claim that its Claude chatbot reproduces their lyrics in its outputs, along with a separate claim under the Digital Millennium Copyright Act. Amodei filed a separate motion to dismiss the direct copyright infringement claim against him personally. The suit, referred to as “Concord II,” was filed in January 2026, seeking more than USD $3 billion over alleged copying of lyrics via torrenting from pirate libraries. Anthropic argued that the publishers’ second amended complaint, asserting infringement of roughly 21,000 works, lacks a single example of an infringing Claude output. The publishers allege that Claude “has generated and continues to generate responses reproducing those lyrics.” Anthropic asked the court to dismiss the output claim “with prejudice.” The earlier case, “Concord I,” was filed in October 2023 and covers 499 works; the court approved guardrails in January 2025, denied a preliminary injunction in March 2025, and allowed key parts to proceed in October 2025. The publishers moved for partial summary judgment in March 2026.
