Filipino artist Elmer Saflor has sued Memes Apps, which runs Memes.ai, over the sale of his comic as an advertising template. Saflor filed the complaint on July 1 in the Central District of California, alleging Memes Apps offered "Running Away Balloon"—a two-panel strip he registered in 2024—to paying subscribers. The original was posted to Facebook in April 2017. The complaint pleads direct, contributory and vicarious infringement, and seeks an injunction and the platform's profits. Unlike the Stability AI and Midjourney cases, the claim does not turn on how a model was trained; Saflor pleads ordinary reproduction and public display, alleging the artwork sat in the template library under its own name. Memes.ai markets plans from $40 to $199 a month with quotas of up to 1,000 meme ads. The complaint leans on the company's marketing to argue willful infringement. Saflor wants a permanent injunction, an accounting of profits, and statutory damages capped at $150,000 per work for willful infringement.
