The Italian High Council of the Judiciary (Csm) has extended the use of Microsoft 365 Copilot to activities involving judicial acts, limited to the analytical and reconstructive phase of the process and not affecting legal, interpretative, or decisional evaluations. With a resolution approved by the plenum yesterday (one abstention), the Csm updated its recommendations on AI use by judges, originally approved last October. The update is motivated by the start, from 1° gennaio 2026, of the experimentation of Microsoft 365 Copilot in judicial offices and technical reassurances from Microsoft via the Ministry. The main novelty is the experimental extension of Microsoft 365 Copilot to judicial acts containing personal data, provided it occurs within the Ministry's institutional tenant and under conditions including mandatory human supervision, blocking checkpoints in automated flows, structured prompts tied to documents, and verification of every output before use. The document experimentally authorizes five categories of use: classification and categorization of procedural acts; structured analysis of parties' acts; documentary synthesis of judicial acts; comparison of procedural positions to identify the subject of the decision and the subject of proof; and assisted compilation of standardized acts, including European arrest warrants. Activities such as formulating the operative part of a judgment, drafting jurisdictional measures, autonomous evaluation of evidence, and forming the judge's conviction remain prohibited.
