In the high-stakes AI legal battle between Midjourney and Hollywood studios, Midjourney CEO David Holz’s company is demanding that plaintiffs Disney, Warner Bros. and Universal disclose all internal uses of AI, arguing the studios are engaged in the same practices they are suing over. A Central District of California Court judge previously ruled studios must hand over information about generative AI uses only in “consumer-facing” videos and images, but Midjourney wants all AI work, including business plans, research reports, training data and board presentations, disclosed during discovery. Last fall, Disney and Universal sued Midjourney for IP infringement because its video generator could create images of copyrighted characters like Shrek, Bart Simpson and Darth Vader; Warner Bros. later joined. Midjourney also filed a motion to throw out claims like “secondary liability,” arguing it should not be held responsible for its users’ actions. A hearing is set for August 17.
