OpenAI has settled with the Department of Justice over allegations of discrimination against U.S. workers, after touting an American jobs boom. The DOJ’s Civil Rights Division announced a $3.2 million settlement with OpenAI, a San Francisco-based artificial intelligence company, and its subsidiary, Statsig Inc., a Bellevue, Washington-based software development company. The settlement addresses claims that the companies discriminated against U.S. workers by giving preference to foreign workers holding temporary employment visas while recruiting through the Permanent Labor Certification (PERM) process, in violation of the Immigration and Nationality Act. The DOJ found that OpenAI failed to publicly post PERM positions on its careers website, required paper applications instead of electronic submissions, and used recruiting practices that allegedly discouraged U.S. workers from applying, including late-night radio advertisements. The PERM program allows employers to sponsor foreign workers for permanent residency if they first make a good-faith effort to recruit qualified U.S. workers. The settlement follows CEO Sam Altman’s September 2025 announcement of an OpenAI Jobs Board and OpenAI Certifications, with a pledge to certify 10 million Americans in AI skills by 2030. OpenAI stated its mission requires attracting and retaining the best talent from the United States and around the world, and it agreed to the settlement to resolve the matter and continue its immigration-related hiring efforts.
