The Pentagon designated Anthropic a supply chain risk in March, and enforcement of restrictions on the company is creating inconsistent compliance demands for defense contractors. Two separate supply chain designations have been issued: one is held up in district court, while the other remains active and is being litigated at the D.C. Circuit Court of Appeals. Because one designation is active, agencies within the Department of War have begun implementing it by asking contractors to certify they are not using Anthropic products in contract performance and are removing them from Department of War Systems. Implementation has not been entirely consistent across agencies or even offices within the same agency. Contractors have received materially different certification requests: some hew to the letter of the law, prohibiting Anthropic use in Department of War or Department of Defense contracts, while others are broader, requesting certifications that contractors are not using Claude at all, going beyond the current state of the law. Subcontractors are also receiving requests from primes, who sometimes flow down the specific government request or send broader checklist certifications to protect themselves from liability. The situation is fluid and evolving, with no one-size-fits-all approach, requiring contractors to examine each certification closely and respond precisely.
