Disney, Warner Bros., and Universal may have to disclose their AI practices amid a court battle stemming from copyright litigation with AI image generator Midjourney. In June, a judge allowed Midjourney to obtain information from the studios about “consumer-facing” AI tools. However, Midjourney recently filed an appeal urging Judge John Kronstadt to overturn that decision, seeking broader information on the studios’ AI business plans, research reports, model weights, training datasets, board meetings related to AI, and other data on how they use AI to create and market movies and TV shows. More than a year ago, Disney and Universal filed a lawsuit against Midjourney, later joined by Warner Bros., alleging copyright infringement for training its AI on copyrighted images without permission. Midjourney’s argument for infringement was “fair use,” and they accused the studios of using the same practices. Although the studios are ready to show data on “consumer-facing” AI tools, they are unwilling to disclose internal information. In June, the magistrate judge denied Midjourney’s attempt to obtain the broad information, finding it irrelevant to the copyright infringement case.
