Musk’s Courtroom Foil Savitt Describes ‘Flow’ of OpenAI Trial

William Savitt, a lead attorney for Sam Altman and OpenAI, convinced a jury to toss out Elon Musk’s lawsuit against Altman. Savitt, who co-chairs the litigation department at Wachtell Lipton Rosen & Katz, was lead attorney during the three-week trial in Oakland federal court. Musk alleged Altman “stole a charity” by converting the Musk-backed nonprofit research lab into a for-profit AI company. The jury spent less than two hours to find in favor of Altman, determining that Musk had waited too long to bring his lawsuit. The legal victory is Savitt’s second against Musk; in 2022, Savitt was counsel for Twitter in its successful lawsuit to force Musk to follow through on his $44 billion purchase of the platform. Musk v. Altman isn’t entirely over, as Musk has pending antitrust allegations against OpenAI, and his team has vowed to appeal the May verdict. OpenAI has advanced its own counterclaims alleging Musk’s lawsuit is part of a harassment campaign. Savitt, who played electric guitar in shows around the Northeast before becoming a litigator, said his courtroom expressions come to him as he’s speaking, part of a tactic to be approachable and informal.
