What the blue tsunami means for AI policy

A Democratic sweep may yield 56 Senate seats and as many as 261 House seats, with wins in Kansas, Texas and South Carolina and Mississippi in play. Over 30 ballot measures to restrict data centers passed, and Democratic governors in Georgia and Texas will likely constrain buildouts further; Goldman Sachs warned investors to expect “short-term data center moratoria, potentially affecting about 45% of planned US data center capacity expansion.” The likelihood of strong frontier AI legislation passing next year “shot up,” with Democrats signaling AI as a top priority; with 56 Senate seats they would need to flip four Republicans. AI industry PACs fell flat—Leading the Future lost in South Carolina, the only competitive race it played in—while safety PACs won big. A bill stronger than Reps. Obernolte and Trahan’s FRONTIER Act, with tough safety standards, mandatory testing and approval of the most powerful models, and narrower preemption language, is expected to pass in the first few months of next year, and entirely new types of AI legislation may be on the table, such as strict liability for developers or data center moratoria. Any bill would still need the president’s signature, which the results make more likely.
