A lawyer for Elon Musk attacked the credibility of OpenAI CEO Sam Altman during closing arguments in an Oakland, California, federal court trial, where Musk is suing OpenAI and Altman for breach of charitable trust and unjust enrichment. Musk’s lawyer, Steven Molo, told jurors that five witnesses, including Musk, former OpenAI board members, and former Chief Scientist Ilya Sutskever, testified that Altman was a liar. Molo noted that Altman did not unequivocally say he was completely trustworthy during cross-examination. OpenAI’s lawyers countered that Musk waited too long to claim OpenAI breached its founding agreement and could not claim he was essential to its success. OpenAI lawyer William Savitt said, “Mr. Musk may have the Midas touch in some areas, but not in AI.” Musk accused OpenAI of manipulating him into giving $38 million and attaching a for-profit business to its original nonprofit, accepting billions from Microsoft and other investors. He is seeking about $150 billion in damages from OpenAI and Microsoft, and wants Altman and President Greg Brockman removed. Musk also accused Microsoft, which invested $1 billion in 2019 and $10 billion in 2023, of aiding the wrongful conduct. OpenAI lawyer Sarah Eddy accused Musk of “selective amnesia” and resorting to “sound bites and irrelevant false accusations.”
